It wont fly, eventually the cops will be buying bikes for those unlucky bastards.

I like the statement: Quote: | Although police claim the confiscation policy is done to save the lives of innocent motorists, no automobile driver has been killed by a motorcyclist on the run. | It sounds like BS to me.
They have to get a tag number first off and the squids that do most of the running don't have tags visable anyway. |

John you may be missing the point
Just suppose that one of the local "enforcers" takes a liking to your ride?
Does this mean that all he has to do is say he saw you and then come and grab it???
wierd country we have here
I liked Montana more when we didn't have a speed limit
And when there were fewer foreigners

This just breaking in the UK apparantly.. Would appreciate an on the spot sitrep if pos ?
florida police seizing bikes
frustrated by the inability to catch hight speed sports bikes , florida police are taking registration numbers and picking up the bikes they consider were speeding later. The owners are charged with a felony , 'running from the police' . And their bikes seized under legisilation which enables the confiscation of felon's vehicles . The felony charges are later dropped but the police get to keep the bike , last year the force grabbed the ridersof 344 motorcyclist . Usually claiming that their owners had run from the police, a felony based on a memory of a licence plate number . No police car can keep up with either a sport biker's top speed or ability to accelerate, and florida police have a policy restricting high-speed chases. Even an innocent motorcyclist will think twice about fighting an unjust seizure ,since the felony charges carry jail time and a permanent black mark on more than just the driving record.

I predict that after the fact seizures will never hold up in court, even in Bush's America.

The Florida Highway Patrol is now asking for larger plates for motorcycles.
We could all trade tags therefor making it had to prove who was where when, we trade every week, rotating down the east coast and up the west.
Everyone mails his tag south until they get to me and I'll send mine north west.
That will fool them bastards!

Unsure about FL but in Oklahoma if the police lose sight of you for any amount of time (ie. you cant just duck around a corner before they do) then they cannot arrest you or charge you for anything. I love that law!!! LOL

I'm not in Florida, but that just does not sound right. Since FL courts dispute everything from elections to the body of Anna Nicole-I would think it would be challenged as well.

I love that law!!! LOL | woah parder! I'd really like more info on that law. I have at least 5 friends who would like to have their court cases revisited. I think it's more like they just go back to the doughnut shop if they cant raise cousin Bubba on the CB in the next town over.
This FL situation seems just crazy. Someone should challenge that laws constitutionality in the courts. In fact this kinda goes along with "..After you pry my cold dead fingers...." kinda thing. I'll stop if told to but you show up at my house looking to take my ride. Better bring SWAT! Fook that better bring the Nat'l Guard!
UK is a police state?!?!?!? Man all I hear about is how fun it is to ride there and such. Coppers bearing down on ya. I'll keep that in mind when I come over this year.

We got automated speed camera's every where ! And not just the ones that fire off as you go past.. There are also ones that read your licence tag and time you over a loooong stretch of road ( maybe 5 miles or more ) .. If your average speed over the distance exceeds the posted limit then you are gonna get a NIP ( Notification of Intended Prosecution ).. For us guys, you get 4 of those over a five year period and your outa the ball game for at least 6 months !
But... on the other hand... if you know where to ride you have what are basically race tracks on the roads ! Florida John knows all about this ! LOL !!
He has been with us when we have done 15 miles of twisty roads in under 10 minutes

| Dunedain- I rarely ride crazy enough to cause to much attention. But if the coppers were to come knockin' I would be less than courteous. A certain ending of a good movie comes to mind... Oh yah, SCARFACE

Yeah, they can take the bike but not for just speeding.
The charge is fleeing to evade arrest or some such legal mumbo jumbo.
They have to light you up and then you have to run away. Plain ordinary speeding won't do it unless you fail to stop when they try to pull you over.
Fleeing to evade is a felony and under Florida law, property used in the commission of a felony is subject to forfeit. If found not guilty, you can get your property back but the rub is in the way they apply this. In order to get your bike back, you have to stand trial for the felony which, if you are found guilty carries both jail time and a substantial fine. Most choose to plea down to a lesser charge but the original seizure still stands and they lose the bike. Still cheap compared to the cost of defending a felony charge and the fact that you are arrested on said felony appearing on your record. Remember, convicted felons lose a good number of constitutional rights and arrest records are public records and may well be included in things like credit checks or employment checks.
Not worth the risk to most.
Of course, running when the police are close enough to get your plate number is a pretty dumb thing to do anyway. |
